Media Wave Inc., doing business as MediaWave ("MediaWave," "we," "our," or "us"), respects your privacy and is committed to protecting the information entrusted to us.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit https://mediawve.com, communicate with us, create or administer an account, or use MediaWave software, applications, websites, and related services (collectively, the "Services").

It also explains how MediaWave handles information that our business customers provide to or process through the MediaWave platform.

1. Our Role and the Scope of This Policy

MediaWave provides technology that enables organizations to manage, process, distribute, analyze, and deliver digital media experiences.

Depending on the circumstances, Media Wave Inc. may process information in different capacities.

Information We Control

When you visit our website, contact MediaWave, request information, create an administrative account, receive marketing communications, or otherwise interact directly with us, Media Wave Inc. determines how and why certain personal information is processed.

Customer-Controlled Data

Our customers may use MediaWave to upload content, manage media libraries, create viewing experiences, distribute programming, analyze playback, manage viewer access, deliver advertising, or perform other media operations.

In these circumstances, Media Wave Inc. generally processes information on behalf of and according to the instructions of our customer. The customer determines what information is collected and how it is used.

If your information was collected through a MediaWave-powered service operated by one of our customers, you should generally direct privacy questions or requests to that organization. We will assist our customers with applicable privacy obligations where appropriate.

2. Information We Collect

The information MediaWave collects depends on how you interact with us and how a customer configures the Services.

Information You Provide Directly

We may collect:

• Name

• Business email address

• Telephone number

• Company or organization name

• Job title

• Account credentials

• Account and profile information

• Communications with our sales, support, onboarding, or technical teams

• Billing and subscription-related information

• Information submitted through website forms

• Preferences and other information you choose to provide

Payment information may be processed by third-party payment providers when applicable. Media Wave Inc. may not directly receive or store complete payment-card information.

Customer Content and Business Data

Customers may provide or process information through MediaWave, including:

• Video, audio, images, and other media files

• Titles, descriptions, tags, and other metadata

• Captions, transcripts, and accessibility information

• Series, episode, channel, and programming information

• Playlists and schedules

• Distribution settings

• Advertising configuration

• Media-management information

• Customer-provided account or viewer information

• Analytics and operational data

Customer Content remains subject to the applicable customer's control and contractual relationship with Media Wave Inc.

Information Collected Automatically

When you use our website or Services, we may automatically collect information such as:

• Internet Protocol (IP) address

• Browser type and version

• Device type

• Operating system

• Pages and features accessed

• Date and time of access

• Referring URLs

• Session and interaction information

• Error, diagnostic, and performance information

• Authentication and security events

When MediaWave provides playback, analytics, authentication, or distribution capabilities for a customer, we may also process technical information relating to content consumption, playback events, devices, sessions, advertising events, and similar operational activity.

Media Wave Inc. does not intentionally collect precise geolocation information through its general website or platform services.

3. Cookies and Analytics

MediaWave uses cookies and similar technologies to operate, secure, analyze, and improve our website and Services.

These technologies may include:

Necessary technologies used for authentication, security, session management, fraud prevention, and core website or platform functionality.

Analytics technologies used to understand website and platform performance, traffic, feature usage, and user interactions.

Preference technologies used to remember settings and improve user experience.

MediaWave currently uses Google Analytics 4 (GA4) to help understand website usage and performance. Google may process technical and usage information in connection with providing these services.

You can control many cookies through your browser settings. Disabling certain technologies may affect the operation or functionality of the Services.

Media Wave Inc. may use information to:

• Provide, operate, maintain, and secure the Services

• Authenticate users

• Process and manage media and Customer Content

• Provide media-management, distribution, analytics, and playback functionality

• Deliver customer-configured experiences

• Provide customer support and onboarding

• Communicate about accounts, services, security, and operational matters

• Respond to inquiries and requests

• Process subscriptions and billing

• Monitor performance and troubleshoot problems

• Prevent fraud, abuse, unauthorized access, and security incidents

• Develop and improve MediaWave products and features

• Understand how the Services are used

• Conduct analytics and business operations

• Send product news, announcements, and marketing communications where permitted

• Comply with legal obligations

• Establish, exercise, or defend legal claims

• Enforce our agreements and policies

5. Artificial Intelligence and Customer Data

MediaWave includes artificial intelligence and machine-learning capabilities designed to assist with media workflows, analysis, metadata, automation, and related functionality.

Media Wave Inc. does not use Customer Content or customer business data to train generalized MediaWave or third-party artificial intelligence models without the customer's authorization.

When an AI-powered feature requires information to be processed by MediaWave or an authorized technology provider, that processing is performed for the purpose of providing the requested functionality and subject to applicable contractual and technical safeguards.

Media Wave Inc. may use aggregated, deidentified, operational, or performance information to improve our Services where that information does not identify a customer, user, viewer, or individual.

6. Communications

We may use contact information to send:

• Account and service communications

• Security notifications

• Technical notices

• Support communications

• Product announcements

• Requested information

• Marketing communications

MediaWave may use communications service providers, including Twilio, to facilitate certain communications.

You may unsubscribe from marketing emails using the unsubscribe mechanism contained in the communication or by contacting us.

Operational, security, billing, and other service-related communications may still be sent when necessary to provide the Services.

7. How We Disclose Information

Media Wave Inc. does not sell personal information.

We may disclose information in the following circumstances.

Service Providers

We may provide information to vendors and service providers that assist us with areas such as:

• Cloud infrastructure and hosting

• Content delivery

• Analytics

• Communications

• Customer support

• Security

• Monitoring and diagnostics

• Billing and payment processing

When a customer directs MediaWave to establish such a connection, information may be transmitted to or received from that third party as necessary to provide the integration.

The third party's own terms and privacy practices may apply to information after it is provided to that service.

Legal and Safety Requirements

We may disclose information when we reasonably believe disclosure is necessary to:

• Protect the security or integrity of MediaWave or our Services

• Investigate fraud, abuse, security incidents, or unlawful activity

Business Transactions

Information may be disclosed or transferred in connection with an actual or proposed merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or similar corporate transaction involving Media Wave Inc.

8. Sale of Personal Information and Targeted Advertising

Media Wave Inc. does not sell personal information.

MediaWave does not currently use personal information collected through its website or platform for cross-context behavioral or targeted advertising.

MediaWave technology may allow customers to configure and deliver advertising within their own media experiences. In those circumstances, the MediaWave customer generally determines the purpose, configuration, audience, and applicable privacy requirements associated with the advertising.

If Media Wave Inc.'s practices change in the future in a manner that creates additional privacy rights or opt-out obligations, we will update this Privacy Policy and implement appropriate controls.

9. Data Retention

We retain information for as long as reasonably necessary to:

• Provide the Services

• Maintain a customer relationship

• Fulfill the purposes described in this Policy

• Maintain security and prevent fraud

• Comply with contractual obligations

• Comply with legal, accounting, or regulatory requirements

• Resolve disputes

• Enforce our agreements

Retention periods may vary based on the type of information, the customer's configuration, contractual requirements, and applicable law.

Customer Content is retained according to the customer's Services, configuration, agreements, and instructions. Customers may have tools or contractual rights allowing Customer Content to be deleted or exported.

When information is no longer reasonably required, we may delete, aggregate, or deidentify it in accordance with applicable requirements.

10. Data Security

Media Wave Inc. uses reasonable administrative, technical, and organizational safeguards designed to protect personal information and Customer Content against unauthorized access, use, alteration, loss, or disclosure.

These safeguards may include access controls, encryption in transit, authentication controls, monitoring, infrastructure protections, security reviews, and restrictions on access to customer information.

No internet transmission, software platform, or storage system can be guaranteed to be completely secure. Users are responsible for safeguarding their credentials and notifying MediaWave if they believe an account has been compromised.

11. Your Privacy Rights

Depending on where you live and the laws that apply to Media Wave Inc.'s processing of your information, you may have rights concerning your personal information.

These may include the right to:

• Request access to personal information

• Request information about how personal information is processed

• Request correction of inaccurate personal information

• Request deletion of personal information

• Obtain a portable copy of certain information

• Opt out of certain uses or disclosures where applicable

• Withdraw consent where processing is based on consent

• Appeal certain decisions concerning a privacy request

• Exercise privacy rights without unlawful discrimination or retaliation

Not every right applies in every circumstance. Certain information may also be exempt from a request under applicable law.

If Media Wave Inc. processes your information solely on behalf of one of our customers, we may direct your request to that customer or inform you that the request should be submitted directly to them.

Where applicable law provides a right to appeal a decision concerning a privacy request, you may submit an appeal by emailing privacy@mediawve.com and including the word "Appeal" in the subject line.

We may request additional information when reasonably necessary to authenticate or process a request.

12. U.S. State Privacy Laws

Residents of certain U.S. states may have additional privacy rights under applicable state law.

Media Wave Inc. will honor applicable privacy rights based on the jurisdiction, nature of the processing, relationship with the individual, and laws that apply to Media Wave Inc.

Nothing in this Privacy Policy is intended to provide fewer rights than an individual is entitled to receive under applicable law.

13. Children

The MediaWave business platform is not designed for children to create MediaWave administrative accounts, and Media Wave Inc. does not knowingly solicit personal information directly from children under 13 through our corporate website.

MediaWave customers may use the Services to distribute family, educational, or children's programming or operate services that are accessible to younger audiences.

In those circumstances, the applicable customer is responsible for determining whether children's privacy laws apply to its service and for implementing appropriate notices, permissions, consent mechanisms, parental controls, and other requirements.

If we become aware that personal information has been collected directly by Media Wave Inc. from a child in a manner inconsistent with applicable law, we will take appropriate steps to address it.

14. Deidentified and Aggregated Information

Media Wave Inc. may create aggregated or deidentified information from information processed through the Services.

We may use this information for analytics, security, product development, service improvement, capacity planning, benchmarking, and other legitimate business purposes when the information cannot reasonably be associated with an identified or identifiable individual.

Where required by law, Media Wave Inc. will maintain deidentified information in deidentified form and will not attempt to reidentify it except as permitted by law.

15. Third-Party Services and Links

The Services may contain links to or integrations with websites, applications, platforms, distribution services, and other technologies operated by third parties.

Media Wave Inc. does not control the privacy, security, or data-handling practices of independent third parties.

We encourage users and customers to review the applicable privacy policies and terms of third-party services before providing information to them or enabling an integration.

16. Changes to This Privacy Policy

Media Wave Inc. may update this Privacy Policy periodically to reflect changes in our Services, technology, business practices, or legal requirements.

When we make changes, we will update the Last Updated date at the top of this Policy.

If a change materially affects how we process personal information, we may provide additional notice where appropriate or required by law.
